2. Service Description

3DWallpaper provides:

• A curated collection of 3D parallax wallpapers optimized for iOS 26
• AI-powered wallpaper generation based on text prompts
• Custom wallpaper request services
• Premium subscription tiers with enhanced features and downloads

3. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans & Billing

4.1 Available Plans

We offer the following subscription tiers:

• Free - Limited access to standard wallpapers, 3 AI generations per day
• Pro ($6.99/month) - Unlimited downloads, 4K resolution, 10 AI generations per day
• Creator ($14.99/month) - All Pro features plus commercial license, early access, and priority support

4.2 Billing

Subscriptions are billed monthly in advance. Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel your subscription.

4.3 Price Changes

We reserve the right to modify our pricing. Any price changes will be communicated to you at least 30 days before taking effect and will apply to your next billing cycle.

5. Refund Policy

We want you to be satisfied with our service. Our refund policy is as follows:

• 7-Day Refund Window - You may request a full refund within 7 days of your initial subscription purchase if you are not satisfied with the service.
• Pro-Rated Refunds - After the 7-day window, refunds are not typically provided, but we may offer pro-rated refunds on a case-by-case basis.
• Cancellation - You may cancel your subscription at any time. You will retain access to premium features until the end of your current billing period.
• AI Generation Credits - Unused AI generation credits do not carry over and are non-refundable.

6. Intellectual Property

6.1 Our Content

All wallpapers, designs, graphics, and other content on our platform are owned by or licensed to Quidity Solutions LLC and are protected by copyright and other intellectual property laws.

6.2 License Grants

All wallpapers provided through our Service are licensed for personal, non-commercial use only. This applies to all subscription tiers:

• Free Users - Personal use license for 1080p downloads
• Pro Users - Personal use license for 4K downloads with extended features
• Creator Tier - Extended personal use with priority access and custom requests

Prohibited uses include: Redistribution, resale, use in commercial products, merchandise, advertising, or any activity intended for monetary gain.

6.3 Third-Party Content Disclaimer

Some wallpapers may contain elements inspired by or resembling third-party intellectual property (including but not limited to characters, brands, or copyrighted artwork). Such content is provided for personal enjoyment only. We make no representations regarding the ownership of depicted subjects. Users are solely responsible for ensuring their use does not infringe third-party rights.

6.4 AI-Generated Content

Wallpapers you generate using our AI tools are licensed to you according to your subscription tier. Important considerations regarding AI-generated content:

• AI-generated content may not be eligible for copyright protection under current law
• You receive a license to use the content, not ownership of intellectual property rights
• Similar outputs may be generated for other users using similar prompts
• You are responsible for ensuring your use complies with applicable laws
• We make no guarantees regarding the uniqueness or exclusivity of generated content

Disclaimer: We do not warrant that AI-generated content is free from potential third-party intellectual property claims. You use AI-generated content at your own risk.

6.5 Trademark Acknowledgments

iPhone, iOS, iPad, and Apple are trademarks of Apple Inc., registered in the U.S. and other countries. All other trademarks, service marks, and company names mentioned on this website are the property of their respective owners. This service is not affiliated with, endorsed by, or sponsored by Apple Inc.

7. Prohibited Uses

You agree not to:

• Redistribute, resell, or share downloaded wallpapers without authorization
• Use automated tools to scrape or bulk download content
• Circumvent any access restrictions or security measures
• Generate content that is illegal, harmful, or violates third-party rights
• Use the AI generator to create explicit, violent, or hateful content
• Impersonate others or misrepresent your affiliation
• Interfere with the proper functioning of the Service

8. Termination

We may suspend or terminate your account and access to the Service immediately, without prior notice, if you breach these Terms. Upon termination:

• Your right to use the Service will cease immediately
• You will not be entitled to any refund of fees paid
• We may delete your account data after a reasonable period

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIDITY SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Quidity Solutions LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Sheridan County, Wyoming, except that either party may seek injunctive relief in any court of competent jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
